1. Introduction & Acceptance
Welcome to CanDrive. These Terms and Conditions ("Terms") govern your access to and use of our website and services. By submitting an application or using this website, you agree to be bound by these Terms, our Privacy Policy, and any additional terms that may apply to specific sections of the site.
2. Description of Service
CanDrive is an online platform that provides automotive lead generation services. We are not a lender, a bank, or a motor vehicle dealer. We do not make credit decisions or offer loans directly. Our service is to collect your information and connect you with third-party partners, including automotive dealerships and financial institutions ("Partners"), who may provide you with vehicle options or financing.
3. Credit Information Authorization
By submitting your application, you authorize CanDrive and our Partners to obtain credit information from your credit profile. This may include a "soft" credit pull which does not affect your credit score, or a "hard" credit pull by a Partner if you proceed with a formal loan application. You certify that all information provided is true and accurate.
4. Consent to Communication (SMS/Email)
By providing your phone number and email address, you grant express written consent to CanDrive and its Partners to contact you via telephone, autodialed calls, pre-recorded messages, text messages (SMS/MMS), and email. These communications are for the purpose of fulfilling your request and marketing related automotive services. You understand that consent is not a condition of purchase and that standard message and data rates may apply. You may opt-out at any time by replying "STOP" to any text message.
5. User Eligibility
To use our services, you must be a resident of Canada, at least 18 years of age (or the age of majority in your province), and possess a valid driver's license. You agree to use the website only for lawful, personal purposes.
6. Limitation of Liability
CanDrive is not responsible for the products, services, or credit decisions of our Partners. Any agreement reached between you and a Partner is solely between you and that third party. CanDrive shall not be liable for any damages arising out of your interaction with our Partners or the use of this website.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved exclusively in the courts of Ontario.
